A 1999–2000 national study of U.S. hospitals raised concerns about ethics consultation (EC) practices and catalyzed improvement efforts. To assess how practices have changed since 2000, we administered a 105-item survey to “best informants” in a stratified random sample of 600 U.S. general hospitals. This primary article details the methods for the entire study, then focuses on the 16 items from the prior study. Compared with 2000, the estimated number of case consultations performed annually rose by 94% to 68,000. The (...) median number of consults per hospital was unchanged at 3, but more than doubled for hospitals with 400+ beds. The level of education of EC practitioners was unchanged, while the percentage of hospitals formally evaluating their ECS decreased from 28.0% to 19.1%. The gap between large, teaching hospitals and small, nonteaching hospitals widened since the prior study. We suggest targeting future improvement efforts to hospitals where needs are not being met by current approaches to EC. (shrink)

It then argues that authoritarian government is often justified through a logic of masculinist protection, and that this is the form of justification for the security regime that has emerged in the United States since September 11, 2001. I argue that those who live under a security regime live within an oppressive protection racket. People often make use of a spatial “mental time line” to represent events in time. We investigated whether the eyes follow such a mental time line during online language comprehension of sentences that refer to the past, present, and future. Participants' eye movements were measured on a blank screen while they listened to these sentences. Saccade direction revealed that the future is mapped higher up in space than the past. Moreover, fewer saccades were made when two events are simultaneously taking (...) place at the present moment compared to two events that are happening in different points in time. This is the first evidence that oculomotor correlates reflect mental looking along an abstract invisible time line during online language comprehension about time. Our results support the idea that observing eye movements is likely to “detect” invisible spatial scaffoldings which are involved in cognitively processing abstract meaning, even when the abstract meaning lacks an explicit spatial correlate. Theories of deliberative democracy presume too narrow an understanding of political communication. Several forms of communication additional to argument are important for political debate, especially between members of more dominant and more marginalized groups. Greeting, rhetoric, and narrative each have important functions for public acknowledgement of interlocutors and communication when premises are not shared.

Toril Moi has argued that recent deconstructive challenges to the concept of gender and to the viability of the sex/gender distinction have brought feminist and queer theory to a place of increasing theoretical abstraction. She suggests that we should abandon the category of gender once and for all, because it is founded on a nature–culture distinction and it tends incorrigibly to essentialize women’s lives. Moi argues that feminist and queer theories should replace the concept of gender with a concept of (...) the lived body derived from existential phenomenology. In this essay I take up and develop this suggestion, and argue that there are several advantages that a category of the lived body has over a category of gender for feminist and queer theories: (1) no nature–culture distinction is necessary but the body can be described as historically and socially specific; (2) it is not necessary to break out a gendered and “raced” part of identity with this category; (3) differences of sexual desire can be described without recourse to an “inner core” of identity or “sexual orientation.” I go on to argue, however, that it is important to retain a concept of gender for a theoretical purpose beyond that which Moi and those she criticizes conceive. In recent years feminist and queer theories have tended to conceive their theorizing as restricted to identity and subjectivity. How large scale social structures differentially position people in relations of privilege and disadvantage has been ignored, relatively. This essay argues then that theorizing structural processes and inequalities is crucial, and that a concept of gender is important for such theorizing. I propose three aspects of gendered social structure that are irreducible to one another: (1) a sexual division of labor (2) normative heterosexuality, and (3) hierarchies of power. In each case I illustrate the social theoretical work these categorizations of gendered structure can and should do. (shrink)

According to the realist, the meaning of a declarative, non-indexical sentence is the condition under which it is true and the truth-condition of an undecidable sentence can obtain or fail to obtain independently of our capacity, even in principle, to recognize that it obtains or that fails to do so.1 In a series of papers, beginning with “Truth” in 1959, Michael Dummett challenged the position that the classical notion of truth-condition occupied as the central notion of a theory of meaning, (...) and proposed that it should be replaced by the anti-realist (and intuitionistic) notion of assertability-condition. Taken together with normalization results obtained by Dag Prawitz, Dummett’s work truly opened up the anti-realist challenge at the level of proof-theoretical semantics.2 There has been since numerous rejoinders from partisans of classical logic, which were at times met with by attempts at watering down the anti-realist challenge, e.g., by arguing that anti-realism does not necessarily entail the adoption of intuitionistic logic. Only a few anti-realists, such as Crispin Wright and Neil Tennant, tried to look instead in the other direction, towards a more radical version of anti-realism which would entail deeper revisions of classical logic than those recommended by intuitionists.3 In this paper, which is largely programmatic, we shall also argue in favour of a radical anti-realism which would be a genuine alternative to the traditional anti-realism of Dummett and Prawitz. The debate about anti-realism has by now more or less run out of breath and we wish to provide it with a new lease on life, by taking into account the profound changes that took place in proof theory during the intervening years. We have in mind in particular the considerable development within Gentzen-style proof theory of non-classical, substructural logics other than intuitionistic logic, which seriously opens up the possibility that anti-realism, when properly understood, might end up justifying another logic, and the development of closer links between proof theory and computational complexity theory that has renewed interest in a radical form of anti-realism, namely strict finitism. Legal responses to battered women who kill have long animated scholarly debate and law reform activity. In September 2012 after 47 years of alleged abuse, Frenchwoman Jacqueline Sauvage fatally shot her abusive husband three times in the back. The subsequent contested trial, conviction for murder, unsuccessful appeal and later presidential pardon of Sauvage thrust the French law of self-defence into the spotlight. The Sauvage case raises important questions surrounding the adequacy of the French criminal law in this area, the ongoing (...) proliferation of gendered stereotypes in law and the need for reform. In the wake of the Sauvage case, this article provides a timely analysis of the gendered law of self-defence in France. Drawing from an in-depth analysis of the judgments imposed in the Sauvage case, this article examines the adequacy of French legal responses to battered women who kill and ignites an argument for further law reform. The commentaries on Evolution in Four Dimensions reflect views ranging from total adherence to gene-centered neo-Darwinism, to the acceptance of non-genetic and Lamarckian processes in evolution. We maintain that genetic, epigenetic, behavioral, and cultural variations have all been significant, and that the developmental aspects of heredity and evolution are an important bridge that can unite seemingly conflicting research programs and different disciplines.

Adaptive evolution is usually assumed to be directed by selective processes, development by instructive processes; evolution involves random genetic changes, development involves induced epigenetic changes. However, these distinctions are no longer unequivocal. Selection of genetic changes is a normal part of development in some organisms, and through the epigenetic system external factors can induce selectable heritable variations. Incorporating the effects of instructive processes into evolutionary thinking alters ideas about the way environmental changes lead to evolutionary change, and about the interplay (...) between genetic and epigenetic systems. Return to Good and Evil: Flannery O'Connor's Response to Nihilism is a superb guide to the works of Flannery O'Connor; and like O'Connor's stories themselves, it is captivating, provocative, and unsettling. Edmondson organizes O'Connor's thought around her principal concern, that with the nihilistic claim that "God is dead" the traditional signposts of good and evil have been lost. Edmondson's book demonstrates that the combination of O'Connor's artistic brilliance and philosophical genius provide the best response to the nihilistic despair of the (...) modern world—a return to "good and evil" through humility and grace. Division is a fundamental procedure in the philosophy of classical Antiquity. It consists of describing an object by inscribing it in a general category (its genus) and then making differences or distinctions within this general category until it is sufficiently characterised. While this procedure has long been despised by secondary literature, in recent years it has come to the attention of a growing number of local studies. By presenting studies of division in Plato and Aristotle side by side, the present (...) issue intends to show that division benefits from being approached from a comparative perspective, in order to highlight both the continuities between the two authors, and the irreducible characteristics of their respective approaches. To create an ecologically literate, motivated, and engaged citizenry, environmental education must help students develop practical wisdom. We discuss three elements of teaching central to this task: first, greater emphasis on contextualized knowledge, grounded in particular places and cases; second, multi-modal learning that engages students as whole persons both cognitively and affectively; and third, stronger connections between knowing and doing, or between knowledge and responsibility. We illustrate these elements through our experience teaching field-based environmental studies courses, but also emphasize ways (...) in which practical environmental education can be effectively incorporated into campus-based classes. This paper explores care ethics and the roles that power, trust, and stereotypes play in establishing and building caring relationships. The work is the result of the evolution of collaboration between teacher and student as that teacher/student dichotomy evolved to one of shared trust and respect and considers the oft-neglected aspect of respect in an ethic of care. By tracing the evolution of the authors’ relationship, we argue that mutual respect in an ethic of care has the potential to enrich (...) our interactions and reshape the way we think about care from primarily unilinear to a more reciprocal model. We propose a modified ethic of care based on mutual trust as a working model for ethics of care-based relationships, particularly with regard to student-teacher interactions, but also perhaps to more broadly extend into our daily interactions with others. Democratic participation and fair representation are not contraries, but rather mutually require one another. In societies with structural injustices that politically marginalize some groups, fairness and inclusion generally require taking special measures to encourage the representation of members of marginalized groups in decision‐making bodies.

Significant criticisms have been raised regarding the ethical and psychological basis of living wills. Various solutions to address these criticisms have been advanced, such as the use of surrogate decision makers alone or data science‐driven algorithms. These proposals share a fundamental weakness: they focus on resolving the problems of living wills, and, in the process, lose sight of the underlying ethical principle of advance care planning, autonomy. By suggesting that the same sweeping solutions, without opportunities for choice, be applied to (...) all, individual patients are treated as population‐level groups—as a theoretical patient who represents a population, not the specific patient crafting his or her individualized future care plans. Instead, advance care planning can be improved through a multimodal approach that both mitigates cognitive biases and allows for customization of the decision‐making process by allowing for the incorporation of a variety of methods of advance care planning. Iris Marion Young (1949-2006) was one of the most influential and innovative political theorists of her generation who had a significant impact on a wide range of topics such as democratic theory, feminist theory, and justice. She bridged many longstanding divides among political theorists, engaging in Continental and critical theory, but also insisting on the importance of normative argument: her corpus stands as a testament to the fruitfulness of engaging in both abstract theory and the 'real world' of everyday (...) politics. This volume spans the several decades of her work, illustrating her intellectual development over time through three major areas of innovation: Gender: Maintaining that gender is both conceptually and politically meaningful, Young theorized gender in terms of structures that, in combination, position different people we call "women" in different ways, such that some women have some structures in common, without all women sharing all gendered structures in common. Justice: Young's early writings on a critical theory of justice evolved in her later and posthumously published works where she developed an account of justice that brought together her theorization of structure with her concern to respond to contemporary claims of injustice. The Politics of Difference: Young rejected universal and abstract theories of justice and maintained that justice instead required attending to the experiences of people marked by difference. The problems of racism and racially motivated violence in predominantly African American communities in the United States are complex, multifactorial, and historically rooted. While these problems are also deeply morally troubling, bioethicists have not contributed substantially to addressing them. Concern for justice has been one of the core commitments of bioethics. For this and other reasons, bioethicists should contribute to addressing these problems. We consider how bioethicists can offer meaningful contributions to the public discourse, research, teaching, training, policy development, and (...) academic scholarship in response to the alarming and persistent patterns of racism and implicit biases associated with it. To make any useful contribution, bioethicists will require preparation and should expect to play a significant role through collaborative action with others. (shrink)

One of the common and commonsensical ways to distinguish cinema from every other art and semiotic system, and to define the property of its uniqueness, is to claim that cinema is the only art/”language” that links images. This “linking” can imply three different yet complementary operations. First, cinema links individual still photographs into an apparently continuous sequence of movement by pushing the individual frames or photographs through a camera or projector at sixteen or twenty-four or however many frames per second. (...) Second, cinema links images by editing , by splicing together individual shots, which are continuous chains of linked frames. Finally, cinema links images with sounds, synchronously or otherwise. The only problem with such an apparently unrestrictive and unprescriptive definition of cinema and the “cinematic” is that it obscures an essentially cinematic operation that precedes the linking of cinema images: the image must first be framed before it can be linked with another.But is framing unique to cinema? Don’t paintings have frames? Aren’t photographs frames? Isn’t the theater’s proscenium arch a frame? A consequence of such perfectly sensible questions is a consistent undervaluing of the cinema frame as an essentially and uniquely cinematic tool, unlike that of any other art, producing serious errors in the writing of film theory and serious misunderstandings of the processes of film history. The goal of this article is to diagnose some of these errors so they might someday be cured. Gerald Mast is professor of English and general in the humanities at the University of Chicago. What ethical challenges do internal auditors (IAs) encounter in their professional role, and how do they navigate these hurdles, especially when weaving risks into their ethical judgments? Anchored in philosophical concepts distinguishing norms from values, and the notion that risk is intrinsically moral, this research delves into interviews of 33 Canadian public sector IAs across various government strata. This primary data are enriched by insights from archival documents and an ethics training session attended by 11 internal audit executives. Our analysis (...) reveals two primary ethical challenges faced by IAs—ethical issues and dilemmas—which unfold in the various contexts we explicate in this study. To address them, IAs tend to favor axiological logic (values driven) over deontological logic (norms driven). However, in some situations, a prudential logic centered on risk becomes their touchstone. Our key takeaways are threefold: (1) a highlight of the ethical quandaries IAs grapple with; (2) evidence that prudential logic, with its merits and flaws, is used to bridge the gap that sometimes exists between professional norms and individual values; and (3) an emphasis on the weak reliance of IAs on the Institute of Internal Auditors Code of Ethics, hinting at avenues for its enhanced outreach and pedagogy. If narrating—the feeling of stories, fictional or otherwise—is an inherent possibility of motion pictures , then Kracauer's distinction between the realist and formative tendencies must be questioned and, in effect, the two must be synthesized. Wasn't the practical problem for the earliest films how to construct a formative sequence of events within an absolutely real-looking visual context? Wasn't the paradox of film narrative the combination of an obviously unreal sequence of events with an obviously real visual and social setting? And (...) isn't that paradox the most intriguing and complex problem of narrative film today, when the visual and social setting have become increasingly real-seeming? And doesn't this paradox have something to do with the fact that narrative film today seems richer and more important than it did a decade ago, at a time when various admirers of both cinéma vérité and cinéma pur had announced the death of fictional filmed narrative? Kracauer's realist aesthetic, concentrating exclusively on the photographic surfaces of things in the material world , overlooks this paradox altogether. It overlooks the fact—extremely relevant to the cinema—that the term "realist" means one thing in its common application to a painting or photograph and quite another thing in its equally common application to a novel or play. A realistic visual image is one that is said to "look like," "resemble," "reproduce," "iconically represent" the surfaces of the visual world. We see—or think we see—in a painting what we see—or think we see—in the real world.1 But a realistic story is one that is said to chronicle "credibly," "probably," and "believably" the way we think people feel, think, or act, the way things happen, and the reasons they happen, all of which are consistent with the reader-audience-society's beliefs about psychology, motivation, and probability. The standard of one sense of realism is primarily visual while the standard of the other is primarily psychological. One might see the early films groping, then, toward a synthesis of the visual realism of late-nineteenth-century painting/photography with the psychological realism of late-nineteenth-century novel/drama. · 1. This equivocation deliberately avoids the question of whether there is anything actually real about what one sees in a painting or photograph. The fact is that a very large number of viewers operate in this assumption because they think there is something real about what they see, despite the theoretical imprecision of their holding such a belief. When Andre Bazin's most important essays on film were collected together in a single volume and titled What is Cinema? they raised a question that Bazin did not answer. Nor did he intend to. Nor has it been answered by any of the other theorists who have written what now seem to be the major works on film theory and who now seem the most influential spokesmen for the art. Rudolf Arnheim, Andre Bazin, Stanley Cavell, S. M. Einstein, Siegfried Kracauer, (...) Christian Metz, Hugo Munsterberg, Erwin Panofsky, and Gene Youngblood have failed to define what cinema essentially is.1 Unlike Ionesco's comically methodical Logician, they have been less than careful about posing the problem correctly. As a result they have been less than successful and less than precise with a deceptively difficult and complicated issue. They have defined some kinds of cinema, they have defined some of the qualities unique to those kinds of cinema, they have defined the characteristics and devices they find most valuable in some of those kinds of cinema, they simply have not defined cinema. · 1.
